Sir I have this day filed in the office of the Clerk of
the Circuit Court of Talladiga County Alabama the
foregoing Interrogations in the Cause above stated & I
Shall on Monday the 16th day of August (just) apply
to the clerk of the said Court for a Commission to issue
to one or more Commissioners to take the testimony of
said Thomas Penn to be read on the final trial of
said Cause. August the 5th 1848 . G T McAfee

Reserving Our exceptions to the above interrogatories and
to each one of them and to the Affidavit because they
are leading illigrade inherant & Multifarious if our except-
ions should be overruled We beg leave to propound
the following Cross interrogatories. Bowdon & Jones & Rice
August the 7th 1848 Atty for Plff

Int G 1st If you state in your answer to succeed
2nd Interrogatory in cheif that you know anything of the
sale therein stated to state your means of information.
State all you know about it. Be careful to state
nothing which does not fall within your own knowl-
edge state nothing from hearsay.

Cross IntG 2nd In your answer to the 3d Interrog-
tory in cheif. if you say that Kenney was embar-
rassed tell only what you know speak of such claim
only as you know of your own knowledge as were
outstanding against him and not what others
may have told you. State whether there were not
other men in the Country involved in debt besides
as well as Shelton Kenney

Cross IntG 3rdIf you state that there was in the
hands of said Dept an attachment in favor
of Plaintiff and against Shelton Kenney and
that said attachment was settled by said
Kenney tell in what way and all about
it Be careful not to state anything that you
dont know of your own knowledge. If you
say anything about the amount of said Attach-
ment tell precisely the amount but dont state
anything unless you know it of your own
