THE STATE OF ALABAMA} IN CIRCUIT COURT,
Shelby COUNTY.} Fall TERM, 1858

The Grand Jury of said County charge that before the finding of this Indictment
Marshall B Smith on his examination as a
witness was duly sworn to testify on the trial of a civil
action before James Crane and acting justice of
the peace for said county between Samuel D Gilliland
plaintiff and said Marshall B Smith defendant which
court had authority to administer such oath testified falsely
that a certain note upon which the said smith was
then sued was not transfered by said month to the
said Samuel D Gilliland, the matter so testafied being
material & the testimony willfully and completly false

against the peace and dignity of the State of Alabama.
